Stolen Valor?

Over at TAH there’s the making of an interesting discussion based on a post by CJ Grisham over at You Served.

CJ thinks the current law violates the Free Speech element of the First Amendment – TSO does not.

Personally, I’m satisfied that the law, as written, has served to raise awareness of a centuries old problem. Still, I think it also CAN abridge free speech.

It seems almost a ‘baby with the bathwater’ issue. Can the law be changed without turning it into just another ‘hitching post’ law that sits on the books for years  and is unenforceable?

Finally, isn’t for the courts to decide if someone’s right to free speech has been abridged or is there just some sort of a priori judgment in play?
